At Authentication & Brand News™, we regularly track important bills and regulations that may impact authentication. In our March issue, we reported on a Georgia (US) house bill calling for all paper voting ballots to carry a visible watermark as a security feature. This month, three new regulations have caught our eye.

Differentiating between AI and ‘real’ content in California

A bill introduced in California aims to develop watermarking standards to differentiate between content created by generative artificial intelligence (AI) and 'real' content derived from cameras and other sources.

The bill requires all AI providers to place watermarks on synthetic content produced, or significantly modified, by generative AI. The providers must also use labels to disclose the provenance data of content uploaded to or distributed via an online platform, and make available downloadable watermark decoders for public use.

Additionally, providers are expected to conduct red-teaming exercises, in the form of periodic, digital intrusions into their own system in order to test its defences.
